Myriam Brulot has been practicing law since 1994. She practices aboriginal law in various areas including aboriginal litigation and Specific Claims research.
Aboriginal Law Experience
Advising clients on a wide range of issues including:
- research and preparation of Specific Claims including timber transactions, railway and highway expropriations, breach of fiduciary/statutory duty in reserve transactions requiring surrender, absence or insufficiency of compensation, wrongful reduction in reserve acreage, illegal alienation of traditional settlement sites and breach of duty in the reserve allotment process;
- part of litigation team on a case in the Federal Court, Trial Division, involving disputed entitlement to a Reserve and the Crown's mismanagement of and breaches of fiduciary duty with respect to this Reserve;
- preparation of transfer and mortgage documents for conveyance of residential housing units on Reserve;
- extensive research in aboriginal law including such topics as:
- the creation or establishment of post-Confederation reserves;
- constitutional division of powers and of property rights;
- the authority for the construction of roads on Reserve;
- the establishment of powers of the Joint Reserve Commissions;
- the application of the BC Limitations Act to aboriginal claims;
- the legality and effect of Order-in-Council 1036;
- the infringement of aboriginal rights;
- the railway belt;
- the scope of various provisions of the Indian Act; and
- Douglas Treaties and Treaty 8
- litigation support in relation to:
- judicial review of government decisions affecting aboriginal and/or Treaty rights;
- scope of Treaty 8 aboriginal rights; and
- numerous issues of administrative law
- provided legal assistance to First Nations addressing provincial infringement of aboriginal rights and title;
- provided legal assistance to First Nations addressing the legality of roads on Reserve; and
- drafted letters of understanding for First Nations/Industry forestry ventures
